This Offer is published online at: https://beardyugin.com/ru/offer.html
The Licensee's performance of the actions specified in this Offer constitutes acceptance of all its terms without exceptions or reservations.

1.6. This Offer governs the relationship between the Licensor and the Licensee concerning the grant of the right to use the Programs.

3.2. The exclusive right to the Program is not transferred to the Licensee.
3.3. Under the granted Licence, the Licensee is entitled to:
3.4. The Licensee may use the Program only within the scope of the granted Licence and the restrictions established by this Offer.
3.5. The grant of a Licence does not constitute a transfer to the Licensee of the Program's source code, the exclusive right to the Program or the right to dispose of the exclusive right to the Program.
3.6. The territory in which the Program may be used is worldwide.
4.1. To enter into the agreement, the Licensee reviews this Offer and the terms of the selected Licence published on the Website.

4.7. If payment is not made, the licence agreement for the relevant paid Licence is not deemed concluded, and the Licensee is not granted the right to use the Program.
5.1. Depending on the selected Program, the Licensee may be granted:
5.2. The specific Licence type, its validity period and other terms are determined by the information published on the Website for the selected Program.
6.1. General Provisions
6.1.1. An offline licence is provided through an activation code.
6.1.2. After payment is confirmed, the Licensor sends the activation code to the email address provided by the Licensee when placing the order.
6.1.3. The activation code is intended to activate the relevant Program under the purchased Licence and is not a separate subject matter of the agreement.
6.2. Perpetual Offline Licences
6.2.1. For Programs for which a perpetual offline licence is offered on the Website, the right of use is granted without a time limit unless expressly stated otherwise for the relevant Program.
6.2.2. A perpetual offline licence is granted for use of the Program on one computer.
6.2.3. The Licence is linked to a computer through an identifier generated by the Program's activation system.
6.2.4. If the computer identifier changes, the activation system may recognise that computer as a new computer.
6.2.5. When changing computers, use of a perpetual offline licence on the new computer generally requires the purchase of a new Licence.
6.2.6. If the computer has to be replaced and no more than six months have elapsed since the Licence was purchased, the Licensor, at the Licensee's request, registers the Program on the new computer free of charge.
6.3. Offline Licence for the “Оформление исполнительных” (“As-Built Drawing Preparation”) Program
6.3.1. The offline licence for the “Оформление исполнительных” (“As-Built Drawing Preparation”) Program is granted for one year.

6.3.3. After the Licence expires, a new Licence must be purchased to continue using the Program.
6.3.4. The Licence is granted for use of the Program on one computer.
6.3.5. When changing computers, the Licensee may contact the Licensor to request transfer of the remaining Licence term to the new computer.
6.3.6. When the Licence is transferred to a new computer, the remaining term of the previously purchased Licence is retained.
6.4. Trial Period for Offline Programs
6.4.1. A 30-day trial period is provided for all Programs.
6.4.2. The trial period is provided to allow users to familiarise themselves with the Program's functionality before purchasing a Licence.
6.4.3. After the 30-day trial period ends, if a Licence has not been purchased, installation of a new version of the Program provides an additional 10-day trial period from the date that new version is installed.
6.4.4. The additional trial period is intended for testing the new version of the Program.
7.1. An online licence is granted for a fixed term.
7.2. An online licence is purchased for a specified period:
7.3. The online licence term is calculated from the date of payment.
7.4. The price of an online licence is determined based on the price of an annual licence for the relevant Program.
7.5. The following factors are applied when calculating the price:
| Term | Factor applied to the annual licence price |
|---|---|
| 1 month | 0.2 |
| 3 months | 0.4 |
| 6 months | 0.6 |
| 12 months | 1.0 |
7.6. The shorter the Licence term, the higher the effective price per month of use. Accordingly, a longer Licence term has a lower effective price per month.
7.7. For example, if a 12-month licence costs 5,000 roubles, the licence prices are:
7.8. The specific price of the selected Licence is displayed to the Licensee on the Website before payment is made.
7.9. The Licensee may purchase additional periods of an online licence. The total paid term of the online licence may not exceed 24 months.
7.10. An online licence may be used on no more than 5 computers simultaneously.
7.11. The Licensee may remove a previously connected computer using the management tools provided by the Website and connect another computer in its place.
7.12. Once the permitted number of simultaneously connected computers is reached, a new computer may be connected after one of the previously connected computers is disconnected.
7.13. Use of an online licence requires an Internet connection and the ability of the Licensor's server to verify the right to use the Program.
7.14. Trial Period for an Online Licence
7.14.1. A 30-day trial period is provided for an online licence.
7.14.2. After installing the Program, the user may activate the trial period.
7.14.3. Use of the online licence trial period is subject to server-side verification of the right to trial access.
7.14.4. After the trial period ends, continued use of the Program through online access requires the purchase of the relevant online licence.
8.1. The Licence price is determined by the Licensor in accordance with the prices and terms published on the Website and in effect at the time the order is placed.
8.2. Before payment is made, the Licensee is shown the information necessary to complete the purchase, including the selected Program, Licence type, validity period and price.
8.3. Payment is made using the methods available to the Licensee on the Website.
8.4. Payment is deemed made when the funds are received by the Licensor or when the payment system confirms that the payment has been successfully processed.
8.5. Legal entities and individual entrepreneurs may pay on the basis of an invoice issued by the Licensor.
8.6. If the Licensor and a legal entity or individual entrepreneur enter into a separate agreement, the terms of that agreement take precedence over this Offer.
9.1. For an offline licence, after payment is confirmed, the Licensor sends the activation code to the email address provided by the Licensee.
9.2. The Licensee enters the received activation code into the relevant Program independently.
9.3. For an online licence, the right of use is verified by the Licensor's server in accordance with the terms of the purchased Licence.
9.4. The Licensee is responsible for the accuracy of the email address and other information provided that is necessary for granting the Licence.
10.1. Use of online licences may require the Licensee to register on the Website and use a Personal Account.
10.2. The Licensee creates the credentials for accessing the Personal Account during registration.
10.3. The Licensee must keep their account access credentials secure and must not allow them to be transferred to third parties.
10.4. The Personal Account may provide functions for managing purchased Licences and connected computers.
10.5. Having an account does not in itself constitute the grant of the right to use a paid Program.
11.1. The Licensor must:
11.1.1. grant the Licensee the right to use the selected Program in accordance with the terms of the purchased Licence;
11.1.2. provide the necessary activation tools where the Program is used through an activation code;
11.1.3. ensure the operation of the Licence management tools provided by the Website within the limits of the Licensor's technical capabilities;

13.3. The use of technical tools or methods intended to circumvent restrictions imposed by the licensing system is prohibited.
14.1. The Licensee may contact technical support regarding the use of the purchased Licence and the Program.
14.2. Program updates are provided to the Licensee at no additional charge within the scope of the purchased Licence.
14.3. The provision of updates is not limited to the version of the Program installed at the time the Licence was purchased.
14.4. Information about the availability of a new version may be displayed directly in the Program.
14.5. Updates are installed at the Licensee's discretion. The Licensee independently decides whether to install an available update.
14.6. The Licensor may release new versions and updates of the Programs and change their interface, functionality and technical specifications. Such changes do not constitute a change to the right of use already granted within the scope of the purchased Licence.
15.1. A perpetual Licence remains valid without a time limit within the duration of the exclusive right to the relevant Program, unless otherwise provided by the terms of a specific Licence.
15.2. A fixed-term Licence terminates upon expiry of its specified term.
15.3. To continue using the Program after a fixed-term Licence expires, the Licensee must purchase a new Licence or renew the existing Licence if that option is available for the relevant Program.
15.4. In the event of a material breach by the Licensee of the Program's terms of use, the Licensor may require the Licensee to cease the breach and apply the consequences of a breach of a licence agreement provided for by law.
16.1. The Licensor refunds payments upon the Licensee's request.
16.2. A refund may be made regardless of the reason for the Licensee's request, including where, after purchasing the Licence, the Licensee concludes that the Program is not needed or that they do not intend to use it.
16.3. To make a refund, the Licensor must be able to identify the relevant payment and the Licensee or the Licence purchased by the Licensee.
16.4. Refunds are made through the payment service used for the original payment or by another available method.
16.5. If the Licensee requests a refund, the Licensor may request the information necessary to identify the payment.
